Article 1. Purpose

These Terms set out the rights, obligations, responsibilities, paid service conditions, refund-related terms, and other matters between the Company and members in connection with Scramble and related services.

Article 2. Definitions

1. "Service" means the Scramble website and all related features, including PDF upload, storage, and deletion, PDF text and image extraction, AI roadmap generation, quiz and flashcard generation, AI grading and explanation generation, mastery tracking, account management, and billing management.
2. "Member" means a person who agrees to these Terms and uses the Service after authentication through a Google account or another method provided by the Company.
3. "Account" means the unit created to identify a Member and manage Service usage records.
4. "Member Content" means PDFs, PDF metadata such as file names and file sizes, subject names, answers, study settings, extracted text and images, AI prompts, and study materials stored through the Service.
5. "AI Output" means AI-based results generated from Member Content or Member requests, including roadmaps, quizzes, flashcards, grading, explanations, mastery estimates, and other AI-generated outputs.
6. "Paid Service" means monthly subscription plans such as Plus and Pro, and pay-per-use purchases for additional storage or AI usage.
7. "Subscription" means a paid service contract that automatically renews on a monthly basis.
8. "Pay-per-use Product" means an additional storage or AI usage purchase available for a specified period.

Article 3. Membership and Account Management

1. A user may become a Member by completing the authentication process provided by the Company, such as Google login, and agreeing to these Terms and the Privacy Policy.
2. Members are responsible for managing their account and authentication methods. Members may not transfer, lend, share, or allow unauthorized use of their account.
3. Members must be at least 14 years old. The Service is not directed to children under 14, and the Company does not provide a separate legal guardian consent process. Children under 14 may not register for or use the Service. If the Company confirms use by a child under 14 or processing of children's personal data, it may restrict or delete the account in accordance with applicable law and Company policy.
4. Members must promptly notify the Company if they become aware of account compromise, unauthorized use, or payment-method misuse.

Article 4. Member Obligations and Prohibited Conduct

1. Members must comply with applicable law, these Terms, in-service notices, and operating policies announced by the Company.
2. Members must have the right to process any Member Content they upload or enter into the Service. Members may not upload materials that infringe third-party rights, including copyright, privacy, trade secrets, or obligations related to protected exam materials.
3. Members must not include unnecessary or specially protected information in PDFs or answers, such as resident registration numbers, passport numbers, health information, financial information, children's personal information, third-party personal data, or third-party sensitive information. Members must not upload or enter that information into the Service.
4. Members may not engage in the following conduct.
   • Uploading or using illegal, harmful, discriminatory, defamatory, obscene, violent, or fraudulent content
   • Circumventing or abusing security features, storage limits, AI usage limits, or billing restrictions
   • Using automation, scraping, or excessive requests in a way that harms service stability
   • Reverse engineering, decompiling, exploiting vulnerabilities, unauthorized access, or abnormal API calls
   • Payment-method misuse, false refund requests, or fraudulent use of subscriptions or pay-per-use products
   • Using the Service for commercial resale, agency use, or model-training data collection without the Company's express permission
5. If prohibited conduct is confirmed or reasonably suspected, the Company may take necessary measures, including content removal, feature restrictions, account suspension, refund restriction, and reporting to relevant authorities.

Article 5. Privacy

1. The Company protects Members' personal information in accordance with applicable privacy laws. Details are provided in the Privacy Policy.
2. Due to the nature of the Service, Member Content and usage records may be processed during PDF upload, PDF metadata processing, text and image extraction, AI prompt construction, AI output generation, study record storage, usage data recording, and payment processing. The Company processes this information only as necessary for service provision, security, abuse and cost-abuse prevention, incident response, deletion handling, customer support, and legal compliance. Members must check PDFs and answers before upload or entry to avoid including unnecessary personal data, sensitive data, government-issued unique identifiers, third-party personal data, or children's personal data.
3. The Company may use external service providers such as Google Cloud, Firebase, Google Gemini API, and Toss Payments to the extent necessary to provide the Service. Details are provided in the Privacy Policy and payment screens.

Article 6. Service Use and Plans

1. The Company provides PDF-based subject management, material upload, AI roadmap generation, quiz and flashcard generation, AI grading, mastery tracking, subscriptions, and pay-per-use purchases.
2. The Service is generally available 24 hours a day, year-round. However, all or part of the Service may be temporarily unavailable due to maintenance, incident response, security measures, external service outages, legal requirements, or operational reasons.
3. The Company may apply limits to file size, storage, AI usage, input length, generation requests, and upload formats for stable service operation and cost control. Current major limits are as follows.

4. AI budget is a usage limit based on actual AI model costs. The number of possible generations may vary depending on PDF length, language, request content, output length, and model pricing.
5. The Company may change features and limits due to law, security, stability, external service policies, or product changes. Important changes unfavorable to Members, such as paid service price increases or conversion of free services to paid services, will be notified in advance or handled through required consent procedures under applicable law.

Article 7. Member Content, AI Output, and Intellectual Property

1. Rights to Member Content remain with the Member or the lawful rights holder. The Company does not acquire ownership of Member Content.
2. Members grant the Company permission to store, reproduce, convert, extract, analyze, display, transmit, back up, and use Member Content for AI processing to the extent necessary for service provision, security, abuse prevention, deletion handling, incident response, quality improvement, and legal compliance.
3. The Company will not use Member Content for its own AI model training, advertising, or public promotional use without the Member's separate consent.
4. AI Output is study assistance material. Members may use AI Output for personal study to the extent permitted by law, but the Company does not guarantee accuracy, completeness, exam suitability, or any specific outcome.
5. Due to the nature of generative AI, AI Output may be inaccurate, outdated, or similar to results provided to other Members. Members must independently review it before using it for important decisions, official submissions, exams, work, legal, medical, financial, or other professional purposes.
6. Rights to the Service software, UI, design, logos, trademarks, database structure, and operational know-how belong to the Company or the lawful rights holder.
7. Copyright or rights-infringement reports may be sent to customer support. The Company may restrict access to or remove relevant content in accordance with applicable law and internal procedures.

Article 8. Paid Service Payment, Changes, and Refunds

1. Members may purchase Paid Services through Toss Payments or other payment methods provided by the Company after checking the product name, price, term, limits, payment method, withdrawal, and refund conditions shown in the Service.
2. Current subscription products are Plus at KRW 9,000 per month and Pro at KRW 40,000 per month. Unless otherwise stated, KRW prices shown in the Service are final payment amounts including VAT.
3. A Subscription starts immediately upon the first payment and automatically renews on the same monthly billing cycle unless canceled. If recurring payment fails, the Company may provide a grace period for paid access and may terminate the Subscription or switch the account to the Free plan after repeated failures or payment-method issues.
4. If a Member upgrades to a higher plan, a prorated difference may be charged immediately based on the remaining period and current plan status. If a Member changes to a lower plan, the change takes effect on the next billing date and does not automatically create a refund.
5. Members may request subscription cancellation at any time. Cancellation is different from a refund. Unless a refund is approved, paid access remains available until the end of the current paid period and renewal stops after that.
6. Pay-per-use Products are available for the period shown at purchase and are not redeemable for cash or transferable to other accounts. The Company may limit the number of active pay-per-use products for security, fraud prevention, and system stability.
7. Refund eligibility and procedures are set out in the Refund Policy. Currently, a refund may generally be requested only within 7 days of purchase or payment, when no new PDF upload, AI roadmap generation, quiz generation, flashcard generation, AI grading, explanation generation, or other AI-powered feature has been used after that purchase, and when payment and policy records can be verified. PDFs uploaded before the purchase remaining in the account after a subscription renewal or payment do not, by themselves, restrict refund eligibility. However, a pay-per-use storage product refund requires that the account's storage usage remain within the remaining limit after that storage capacity is removed.
8. Members understand that withdrawal or refund may be restricted under applicable law and the Refund Policy once digital content or services have begun after that purchase, including new PDF upload, AI generation, or AI grading. Rights guaranteed by mandatory law, such as where the Service differs from displayed or contracted terms, are not limited.
9. After a payment cancellation or refund is approved, the timing of card cancellation, deposit, or limit restoration may vary depending on the payment gateway and payment-method provider.
10. If mandatory applicable law provides Members with rights more favorable than these Terms or the Refund Policy, that law prevails.

Article 9. Restrictions, Withdrawal, and Account Deletion

1. Members may request account deletion at any time through the process provided in the Service.
2. After an account deletion request, the Company may provide a grace period for recovery or cancellation. After the grace period, PDFs, study records, quizzes, flashcards, subjects, and other account-related data are deleted. However, payment, dispute, and fraud-prevention records required by law may be retained separately to the necessary extent.
3. If a Member violates these Terms, harms service stability or security, infringes third-party rights, or engages in payment abuse, the Company may restrict use after prior notice.
4. For urgent security risks, illegal acts, rights infringement, or payment-method theft, the Company may impose necessary minimum restrictions without prior notice and, where possible, notify the Member of the reason afterward.

Article 10. Limited Warranty and Liability

1. The Company makes reasonable efforts to provide a stable Service. However, it does not promise that the Service or AI Output will always be uninterrupted, error-free, or guarantee any academic result, exam pass, or score improvement.
2. Members must use AI Output as assistance material and review it before relying on it for important study decisions, official submissions, or exam preparation.
3. Members are responsible for the legality, rights clearance, personal information content, and purpose of use of Member Content they upload.
4. Except for the Company's intent or gross negligence, or liability that cannot be excluded under applicable law, the Company is not liable for damages caused by a Member's breach of these Terms, Member Content, external service failures, or force majeure.
5. If the Company is liable for damages in connection with a Paid Service, unless applicable law provides otherwise, the scope of liability will be calculated within a reasonable range based on the recent payment amount directly related to the damage.

Article 11. Changes to These Terms

1. The Company may change these Terms due to applicable law, service changes, security, or operational needs.
2. The Company will notify Members of the effective date, details, and reasons for changes through screens within the Service or another appropriate method. Important or unfavorable changes will generally be notified at least 30 days before the effective date, and any longer period or separate consent required by law will apply.
3. If a Member does not agree to the changed Terms, the Member may stop using the Service and request account deletion or subscription cancellation before the effective date. For matters requiring explicit consent under law, such as a paid service price increase or conversion from free to paid service, the required consent process will apply.

Article 12. Governing Law and Dispute Resolution

1. These Terms and use of the Service are governed by the laws of the Republic of Korea.
2. If a dispute arises between the Company and a Member, both parties will make good-faith efforts to resolve it through consultation.
3. Any lawsuit that cannot be resolved through consultation will be brought before the competent court under applicable laws, including the Korean Civil Procedure Act.
